IOD in Real Estate: Full Form, Meaning & Why Buyers Should Check It

What Is IOD in Real Estate? A Buyer's Guide to Intimation of Disapproval

Ask a Mumbai developer about approvals and you'll probably hear about the "IOD" before anything else. Many buyers are startled when they first see it written out in full: Intimation of Disapproval. It sounds like the project was rejected. It wasn't. In fact, the IOD is one of the first approvals a project needs, and knowing how to read it can tell you a lot about where a project really stands.

What Is the IOD Full Form in Real Estate?

The IOD full form is Intimation of Disapproval. It is a document issued by the Brihanmumbai Municipal Corporation (BMC) under Section 346 of the Mumbai Municipal Corporation Act, 1888, after it examines a developer's building plans.

Despite the name, an IOD is not a rejection. It's a conditional approval of the building plans. The corporation tells the developer, in effect: your plans are acceptable, but you cannot start construction until you meet the conditions listed here.

The word "disapproval" comes from the legal format. Construction stays disapproved until every listed condition is satisfied.

What Does an IOD Contain?

An IOD is essentially a long list of conditions the developer must meet at different stages of the project. Typical conditions include:

  • Obtaining the Commencement Certificate (CC) before starting construction
  • Handing over any setback land required for road widening
  • Getting NOCs from bodies such as the Chief Fire Officer, Tree Authority, and traffic and storm water departments
  • Paying municipal charges, premiums and development fees
  • Meeting specific conditions before applying for the Occupancy Certificate (OC)

Some conditions must be met before work starts, some before the plinth or upper floors, and some before the building can be occupied. That's why buyers and lawyers often go through the IOD line by line.

IOD vs CC vs OC: What's the Difference?

These three documents mark three different stages of a project.

IOD (Intimation of Disapproval) is the conditional approval of building plans. It says the plans are acceptable, subject to conditions.

CC (Commencement Certificate) is the actual permission to start construction. It's issued only after the developer satisfies the IOD conditions required at that stage. In Mumbai, it's often issued in parts, for example up to the plinth first and then for the upper floors.

OC (Occupancy Certificate) is issued once construction is complete. It confirms the building follows the approved plans and is fit to live in.

In short, the IOD approves the plan, the CC lets construction begin, and the OC lets you move in.

You may also come across an IOA (Intimation of Approval) on some Mumbai project documents. It works as a similar plan-approval stage before the CC.

How Does the IOD Process Work?

While details vary by project, the typical IOD process in Mumbai looks like this:

  1. Title and land documents are put in order, including ownership records and the property card
  2. Building plans are submitted to the BMC's Building Proposal department through an architect
  3. The BMC scrutinises the plans against the development control regulations and zoning rules
  4. The IOD is issued with a list of conditions to be met
  5. The developer secures NOCs, pays charges and complies with the pre-construction conditions
  6. The Commencement Certificate is issued, and construction can legally begin
  7. The OC is applied for after completion, once the remaining IOD conditions are met

IOD, CC and RERA: Why the Order Matters

Under the Real Estate (Regulation and Development) Act, 2016, a developer must register a project with the state RERA authority before marketing or selling units. In Maharashtra, approved plans and the Commencement Certificate form part of the documents filed with MahaRERA.

For buyers, this sequence is a useful reality check:

  • An IOD alone means the plans are approved in principle, but construction cannot legally begin
  • A CC means construction is permitted, at least up to the level it covers
  • RERA registration means the project can legally be sold

A project that only has an IOD and is already collecting bookings deserves extra scrutiny. Also note that a Commencement Certificate under the Maharashtra Regional and Town Planning Act is generally valid for one year and must be renewed if work doesn't start in time.

Is IOD Used Outside Mumbai?

The IOD is specific to Greater Mumbai. Outside Greater Mumbai, there's usually no separate IOD stage. The planning authority moves straight to sanctioning the building permission and the Commencement Certificate.

In Gurgaon, for example, you won't see an IOD at all. Here, the equivalent checks are the building plan approval from DTCP or the relevant authority, the developer's licence, Haryana RERA registration, and finally the Occupation Certificate once the project is complete. The principle is the same everywhere: confirm the plans are approved before you pay, and confirm the OC before you take possession.

Things to Check Before Booking a Flat in Mumbai

  • A copy of the IOD, and whether its pre-construction conditions have been met
  • The Commencement Certificate, and the floors it currently covers
  • That the CC is valid and renewed, if the project has been under construction for a while
  • The project's MahaRERA registration number, verified on the official portal
  • The developer's track record on delivery and obtaining the OC
  • That the floor you're buying falls within the approved plans, not a future or unapproved floor

Final Thoughts

An Intimation of Disapproval sounds alarming, but it's simply the first formal step on a project's approval journey. On its own, though, it doesn't let a developer build, and it certainly doesn't mean your flat is ready. Treat the IOD as a starting point: ask for the CC, check the RERA registration, read the conditions, and make sure each approval matches the stage the project claims to be at.
